In this article we will discuss the Utah probate: what it is, who needs it, and the steps that you will need to take to make the process as simple as possible. But first, what is a probate?

“Utah Probate is the court process of wrapping up the affairs of a person who has died, paying the debts, and transferring his or her property to others,” according to Utah Elder Law. The main purpose of a probate is to transfer property to heirs after death. Usually, a probate will only be needed if the deceased has left property that cannot be passed down to heirs without a court order.

After deciding that a probate will be needed the next issue is whether to use a formal or informal probate. An informal probate is used when parties can proceed in agreement. A formal probate is needed when an agreement cannot be reached, and a judge is asked to intervene.
